MINUTES OF REGULAR TOWN BOARD MEETING
LAGRANGE TOWN BOARD
October 11, 2004

The regular monthly meeting of the Town Board of the Town of LaGrange was called to order by Chairman Heilmeier. Chairman Heilmeier, Supervisor Callaway, Supervisor Sukala, Supervisor Lohrmann and Supervisor Taylor were present. Crystal Hoffmann, Clerk/Treasurer and Elizabeth Adelman, Town Attorney were also present.
  1. The minutes of September 13, 2004 were approved as presented (Sukala/Lohrmann).
  2. Treasurer’s report was accepted as presented.
  3. The agenda was approved with the addenda (Lohrmann/Sukala).
  4. Committee Reports:
        a. Buildings and Highways: no meeting held
        b. Safety committee

        i. The LESD logged 328 hours, 31 citations and 54 warnings in September. Boat will be out of the water the end of October.
        ii. Fire Department—nothing to report
        iii.Discussed tubing ordinance—recommend allowing up to 4 individuals per tube only if the manufacturer recommends such. iv. Discussed dog ordinance—need to add clause for owners to clean up after dog
        v. Buoys—1/2 are out already, main ones to remain until just before ice sets in, 3 “keep to right” buoys will be replaced
        vi. Launch ramps—Mann Bros. to be paid for 1st two ramps, still in process with second two ramps

        c. Lake Management Districts:
        i. Pleasant Lake: next meeting November 13th
        ii. Lauderdale Lakes Management: Refinanced golf course, entered into program with the East Troy High School science department, golf course is down in rounds, but not behind in revenue
        d. Finance and Personnel: working on capital expense needs for future, and finding out what the Town really has for a contingency fund balance, also request that Crystal give Joel a monthly expense report for the LESD
        e. Information committee: looking for articles to be put on the tax flyer
  5. Planning and Zoning:
        a. PUBLIC HEARING: Discussion/possible action of adopting the new Walworth county conservation subdivision ordinance as mandatory for the Town of LaGrange—plan and zone commission recommends making this mandatory for the entire Town of LaGrange. Motion to approve the “long version” of the ordinance which includes specific documents be provided to the Town and the Town must approve the sketch plan, conservation land ownership and maintenance documents (Callaway/Taylor) Heilmeier, Callaway and Taylor-yes, Sukala and Lohrmann-No—Motion Carries.
        b. Variance request for Robert and Heather Markwart, N8611 Forrest Road—requesting a 5.85 foot shore yard variance and a .92 foot side yard variance. Plan and zone commission recommends accepting this proposal minus the second floor deck. Motion to approve the variance without the second floor deck (Lohrmann/Callaway) Motion carries.
  6. Use of TASER by the LESD—safety committee recommends approval, only trained individuals may use, and the Town buys no tasers. Motion to approve use (Lohrmann/Sukala) Motion carries.
  7. Approval/appointment of additional election workers for the November 2nd election: Sylvia Baker, Jane Kwasinski, David Heilmeier, and Richard Callaway. Motion to approve (Lohrmann/Taylor) Motion carries.
  8. Proposed amendment to Ordinance No. 012001, An ordinance to regulate water traffic, boating and water sports upon the waters of Lauderdale Lakes, regarding tubing behind boats—safety committee recommends allowing up to 4 people per tube if manufacturer recommends such. Motion to table (Lohrmann/Taylor) will put on agenda for November. Motion carries.
  9. Amending the ordinance to regulate Dogs. Safety committee recommends amending the current ordinance to include the requirements of leashes and the owner cleaning up after the dog has defecated. Motion to approve (Lohrmann/Callaway) Motion carries.
  10. Approval of the two year maintenance agreement with Equity Appraisal for the assessment duties of the Town of LaGrange for $13,200 per year. Motion to approve (Lohrmann/Taylor) Motion carries.
  11. Payment of bills properly submitted for payment—Sukala/Taylor

The meeting then moved into closed session per role call vote: Taylor-aye, Lohrmann-aye, Sukala-aye, Callaway-aye, and Heilmeier-aye.

Motion to go into open session (Lohrmann/Callaway) Motion carries.

Motion to instruct Attorney Adelman to reply back to Unbehaun’s that the Town agrees that we don’t own the road.

There being no further business a motion to adjourn was made at 9:03 p.m. (Lohrmann/Taylor) Motion carries.
