MINUTES OF REGULAR TOWN BOARD MEETING
LAGRANGE TOWN BOARD
October 8, 2007


The regular monthly meeting of the Town Board of the Town of LaGrange was called to order by Chairman Taylor. Supervisor Bromley, Supervisor Sukala, Supervisor Callaway, and Supervisor Schramm were all present. Crystal Hoffmann, Clerk/Treasurer and Elizabeth Adelman, Town Attorney were also present.
  1. The minutes of September 10, 2007 were approved as presented (Sukala/Schramm)
  2. Treasurer’s report accepted as presented
  3. The agenda was approved with addenda and moving #1 on addenda up with the safety committee report (Bromley/Callaway) Motion carries
  4. Committee Reports:
        a. Buildings and Highways: 2 items—the chimney repair is completed and we are out of launch fee envelopes again. Have gone through 1500 so far this year. Motion to order 2000 to have on hand for next season (Schramm/Callaway) Motion carries.
        b. Safety committee: noise ordinance—taking back to water safety patrol, use disorderly conduct ordinance instead of having noise ordinance, Fire Department—will have a fundraiser for purchasing a new ambulance; Officer Tim Otterbacher, Walworth County Sheriff Department—had 127 calls in July, 92 calls in August, and 75 in September. Nothing major going on in the Town of LaGrange
        c. Lake Management Districts: nothing to report
        d. Finance and Personnel: no meeting
        e. Information committee: no meeting
  5. Planning and Zoning: did not have a quorum to have a meeting on October 2, however council has given the opinion that the Town board can act on items a and b without Plan and Zone commission members input
        a. Separation from ordinary high water mark for David Zasada, HLPO 00007E—need variance to pour concrete over 2 holding tank covers—Motion to approve (Bromley/Schramm) Motion carries.
        b. Separation from ordinary high water mark for Carmella Petzel, HLPO 0007D—need variance to pour concrete over holding tanks—Motion to approve (Bromley/Schramm) Motion carries.
        c. Farm separation for Larry and Terry Pechous, W5908 Territorial Road—Motion to table until November (Callaway/Schramm) Motion carries.
        d. Town zoning survey—Motion to go ahead and send survey out with tax bills in December (Callaway/Schramm) Motion carries.
        e. Nothing to report
  6. Ordinance regarding boat launch fees—Motion to table (Callaway/Bromley) Motion carries.
  7. Lauderdale lakes safety ordinance—Water traffic ordinance, items being changed are as follows, each item was discussed at length:
        a. One way, counter-clockwise, traffic between the bog on Don-Jean bay and the shoreline on weekends, and Holidays from Memorial Day through Labor Day. Motion to approve (Callaway/Sukala) Motion carries.
        b. Require permits for organized events and displays on the Lauderdale Lakes—needs a little more definition
        c. Limiting the hours for water-skiing, aquaplaning, or similar activities during the week from sunrise to sunset except on Saturdays and Sundays and Holidays may not commence until 9 a.m.—after much discussion, Motion to approve (Callaway/Sukala) Motion carries.
        d. Changing the nighttime speed limit from 15 MPH to 10 MPH, including weeknights, Motion to approve (Callaway/Bromley) Motion carries.
        e. Limiting top speed during daylight hours to 50 MPH on weekends and Holidays from Memorial Day through Labor Day, Motion to approve (Callaway/Sukala) Motion carries.
        f. Recognizes the partnership between the Lauderdale Lakes Lake Management District and the Town of LaGrange in operating the water safety patrol on Lauderdale Lakes and Pleasant Lake, Motion to approve (Sukala/Schramm) Motion carries.
        g. Authorizes the water safety patrol to have limited responsibility on some shore properties (boat house, launch ramps, Pleasant Lake Beach), Motion to approve (Bromley/Schramm) Motion carries.
        h. Increases fines for violations, minimums and maximums, and extends the penalties for repeat offenders from one year to three years—can only change ordinance fines, State violations are controlled by State Statute, Motion to approve (Bromley/Sukala) Motion carries.
  8. Lauderdale Lakes conservation ordinance—doesn’t DNR control this area, why do we need an ordinance for such, Motion to go back to Heidi Bunk at the DNR and see why the Town would need such an ordinance. (Callaway/Bromley) Motion carries.
  9. Lauderdale Lakes Slow No Wake suggestion—suggesting 2 days through summer of slow no wake on Lake—much discussion, Motion to take NO action (Bromley/Schramm) Motion carries.
  10. Cost-share agreement with Walworth County and Town of LaGrange for beach and boat house project—right now the total cost is $44,600 and Town’s share would be $13,380 plus all engineering fees, Motion to table (Callaway/Schramm) Motion carries
  11. Enforcement of pier ordinance:
        a. W5627 Forest Road—was in existence prior to 1999 so grandfathered
        b. W5284 Lauderdale Drive—owner is bringing into compliance
  12. Ordinance requiring bonds for construction—incorporates occupancy bond, change section3 paragraph to include or passed final inspection—Motion to approve with change (Schramm/Bromley) Motion carries.
  13. Lights for parking lot—Don will check with WE Energies, possibly dusk to dawn lights or lights on a timer so would only be on if someone at the Town Hall.
  14. 2010 census—will do in conjunction with Walworth County
  15. Assessor maintenance contracts for 2008-2010—increased fee to $14,000, Motion to approve (Schramm/Sukala) Motion carries.
  16. Revaluation for 2010—Motion to table until 2008 (Sukala/Bromley) Motion carries.
  17. Interviewing possible Town attorneys---Betty gave us a list of attorneys, will send letter to all requesting resumes and hourly rates, will do interviews on November 5, 2007 at 3 p.m. at Town Hall.
  18. Aeration permit for Beth Mitchell, W5352 Plantation—Motion to approve (Bromley/Schramm) Motion carries.
  19. April 2005 election—keep getting voice mail
  20. Pleasant Lake Culvert—Don still working on, in 1992 cost $2,750 to do the job.
  21. Payment of bills submitted for approval—Motion to pay bills submitted (Callaway/Schramm) Motion carries.


  22. The meeting then moved into closed session for the purpose of conferring with counsel regarding a possible lawsuit per roll call vote: Schramm-aye, Callaway-aye, Sukala-aye, Bromley-aye, and Taylor-aye.

    The meeting then moved out of closed session by motion (Schramm/Sukala)

    There being no further business a motion to adjourn was made at 9:50 p.m. (Schramm/Callaway) Motion carries.
