MINUTES OF REGULAR TOWN BOARD MEETING
LAGRANGE TOWN BOARD
February 12, 2007

The regular monthly meeting of the Town Board of the Town of LaGrange was called to order by Chairman Taylor. Supervisor Bromley, Supervisor Sukala, Supervisor Lohrmann, and Supervisor Schramm were all present. Crystal Hoffmann, Clerk/Treasurer and Elizabeth Adelman, Town Attorney were also present.

  1. The minutes of January 8, 2007 were approved as presented (Bromley/Sukala)
  2. Treasurer’s report was accepted as presented.
  3. The agenda was approved (Bromley/Sukala) Motion carries
  4. Committee Reports:
        a. Buildings and Highways: no meeting held
        b. Safety committee: no meeting, Walworth County Sheriff Department has appointed an officer to be a liaison between Town and County—Officer Tim Ottabacher
        c. Lake Management Districts: Pleasant Lake had two meetings, talked about mil foil and environmentally sensitive areas
        d. Finance and Personnel: no meeting
        e. Information committee: working on April newsletter
  5. Planning and Zoning:
        a. Conditional use request for a conservation subdivision on the Lawton property on Highway H—plan and zone commission recommended to deny this proposal, much discussion ensued, Motion to approve (Sukala/Lohrmann) Motion fails with Lohrmann and Sukala yes votes and Taylor, Bromley, and Schramm nay votes. Motion to deny proposal because plan is in conflict with Town’s land use plan (Taylor/Schramm) Motion carries with Taylor, Bromley, Schramm yes votes and Sukala and Lohrmann nay votes.
        b. Conditional use request for Russ Keske for a conservation subdivision on Highway 20—Plan and zone denied application, much discussion, Motion to approve (Lohrmann/Sukala) Motion failed with Sukala, Lohrmann-ayes, Taylor, Bromley, Schramm-nays. Motion to deny proposal because plan is in conflict with Town’s land use plan (Schramm/Taylor) Motion carries with Taylor, Bromley, Schramm voting yes and Sukala and Lohrmann voting no.
        c. Variance from rear yard setback and height requirement on accessory structure for Roderick Sievert—has signatures from all neighbors in support of variance request, plan and zone commission recommends approval, Motion to approve (Sukala/Schramm) Motion carries.
        d. Variance request for Paul and Josephine Barrett, Green Lake Drive, for a shed—Bill Kwasinski only neighbor and is support of request, Plan and zone recommends approval, Motion to approve (Schramm/Lohrmann) Motion carries.
        e. Variance for a circle drive (creates 2 driveways) for Neil Siegel, N7932 West Shore Drive—didn’t need to be heard by Plan and zone, Town has ordinance against allowing two driveways, Motion to have Attorney Adelman amend our ordinance to allow the Town Board to grant variances (Schramm/Sukala) Motion carries.
        f. Conditional use request for Formolo on the Racine Girl Scout Camp property—request to table until further notice from petitioner, Motion to table (Sukala/Schramm) Motion carries.
        g. Conditional use request for Code Family on Racine Girl Scout Camp property—request to table until further notice from petitioner, Motion to table (Sukala/Schramm) Motion carries.
        h. Conditional use request for Code’s on the Racine Girl Scout Camp property—request to table until further notice from petitioner, Motion to table (Sukala/Schramm) Motion carries.
        i. Rezone request for William/Joyce Lawton Trust, W6920 Kettle Moraine Drive, from A-1 to A-5 (1.03 acres)—plan and zoning recommends approval, want to divide off tenant house and sell property, Motion to approve (Schramm/Lohrmann) Motion carries.
        j. Review of land classifications—Plan and zone commission asking Town Board to hold public hearing for rezoning 8 parcels from C-2 to A-1 or A-2, much discussion and public comment, Motion to hold hearing to rezone these eight properties with notice given to property owners and adjacent property owners for a March hearing (Schramm/Taylor) Motion carries.
  6. Public hearing for a moratorium—Plan and zoning recommends moratorium of up to one year on subdivisions in the Town of LaGrange, much discussion and public comment, Motion to establish a six month moratorium on all subdivisions in the Town of LaGrange which would cover all properties whether a project is going or not (Bromley/Schramm) Motion carries with Taylor, Bromley, Schramm-aye votes, and Sukala, Lohrmann-nay votes.
  7. Town engineer—send out letters to Strand and Associates, Farris Hansen, Crispell-Snyder, RSV Engineering, R.A. Smith and Associates.
  8. Slalom course permit for Mike Baker—same as last year, don’t use often as conditions won’t allow it, Motion to approve (Lohrmann/Schramm) Motion carries.
  9. Upgrading fertilizer ordinance—City of Delavan just expanded their ordinance to have sellers of fertilizer post a sign, Motion to add an amendment to our fertilizer ordinance stating merchants in the Town of LaGrange must post a sign stating that if you live in the Lauderdale Lakes Lake Management District you can not use phosphorus fertilizers (Schramm/Bromley) Motion carries.
  10. Launch ramp fees ordinance—DNR suggests collecting fees, Fees will be as follows: $3 for a daily launch, $20 for yearly, and $100 for contractors. All fees include sales tax. Motion to approve fees and for Attorney Adelman to draft ordinance (Bromley/Schramm) Motion carries.
  11. April 2005 election—investigation is ongoing
  12. Payment of bills properly submitted for payment—Sukala/Schramm—Motion carries

Motion to go into closed session for possible litigation—roll call vote: Schramm-aye, Lohrmann-aye, Sukala-aye, Bromley-aye, Taylor-aye.
Motion to resume in open session—Bromley/Sukala
There being no further business a motion to adjourn was made at 10:12 p.m. (Schramm/Taylor) Motion carries.
