Town Board Meeting (July 2009 minutes) Minutes For 7/13/2009
The regular monthly meeting of the Town board of the Town of LaGrange was called to order by Chairman Frank Taylor at 7:30 p.m. Present were Supervisor Mark Bromley, Supervisor Don Sukala, and Supervisor Jeff Schramm. Also present was Crystal Hoffmann, Clerk/Treasurer. Absent was Supervisor Rick Callaway.
Following the agenda:
  1. Approval of Minutes of last month’s (6/8/09) meeting (Sukala/Schramm)
  2. Treasurer Report
  3. Approval of Agenda(Bromley/Schramm)
  4. Committee Reports, if any from:
        a. Buildings and Highways
        b. Safety—Fire Department—open house this Saturday from 11-3 at the Department, celebrating 50 years; discussed shore ordinances/regulations from DNR
        c. Lake Management Districts' Reports—preparing preliminary budget, public meeting on Saturday, July 25 here at the Town hall regarding violations in the sensitive areas of the Lake, also want to discuss the ski club
        d. Finance & Personnel—no meeting
        e. Information committee—no meeting
  5. Planning and Zoning Commission
        a. Variance request for Richard & Janice Anders, N7498 Bay Drive, for a 10’ street yard setback (zoning requires 25’) and a 6’ side yard setback (zoning requires 12.64’) for a detached garage—went to county board of adjustment already, plan and zoning recommended approval, no board action necessary
        b. Information/discussion of a possible grocery store at the intersection of Hwy 12/67, Ken Micheloni—no appearance at plan and zoning meeting, no appearance at Town Board
        c. Review and discussion of Smart Growth Chapters 15, 16, & 17—concluding chapters of the smart growth work, will be a special public hearing here at the Town hall on September 3, 2009, the land use map will be presented and discussed at that time, County representatives and SEWRPC will be here as well for questions, no action needed
        d. Scheduling an open house & public hearing for the adoption of the Comprehensive land use plan for the Town of LaGrange—already set for September 3, 2009
        e. Review of the resolution to adopt the Comprehensive Plan for the Town of LaGrange—Plan and zone commission, will wait to hear from Attorney John Macy with recommendations, no action taken
        f. Review an d recommendation to Walworth county regarding the conditional use permit for Lauderdale Shores Condominium Campground— puts into effect that residents prove that they are not present 365 days a year, currently there are 4 full time residents in the campground and they will be allowed to remain, but no more will be allowed; Plan and Zoning recommends approval, Motion to approve (Bromley/Schramm) Motion carried.
  6. Review of the resolution for the adoption of the Comprehensive Plan for the Town of LaGrange—Town Board—Will wait to hear Attorney Macy’s recommendations, put on August agenda
  7. Approval of ordinance to reduce the speed limit on Kettle Moraine Drive from 55 MPH to 45 MPH—Motion to approve (Bromley/Schramm) Motion carries.
  8. Revisions to the pier ordinance—change Section II. to: repair an existing non-complying pier and change Section VI. A. to read any non- complying wharf, pier, Motion to adopt the changes to the pier ordinance (Bromley/Sukala) Motion carries. In essence what this does is as long as you have a complying pier you may replace the entire pier without a permit as long as you are not changing the pier and it will remain a complying pier, if you have a non-complying pier you may only replace 10% of its surface square feet in one year or 50% of the posts without a permit
  9. Possible violation of pier ordinance at W5189 Sterlingworth Court, Elkhorn, James Vito—Supervisor Callaway has suggested to remove the “L” of the pier and then Young’s would move their pier away from the property line of the Vito property, would be removing 4 feet of the pier, Motion to table the matter until August’s meeting and that the property owners come in with a solution or legal action will be taken by the Town Board to prosecute the violations (Bromley/Sukala) Motion carries.
  10. Possible violation of pier ordinance at W5183 Sterlingworth Court, Joanne Young—has moved his pier off the Vito property line, moved back to what was sent in to the Board in the pier survey of 2007, did move their pier after they purchased the property—see number 9.
  11. Bond ordinance—if repeal this ordinance, would have to create a new one to cover any damage to the roads, Motion to repeal the bond ordinance and to refund all bonds that have been collected (Bromley/Schramm) Motion carries.
  12. Damage to road at W5539 Oak Park Road, Elkhorn from construction—already being handled by Pat Hoffmann, Road commissioner
  13. John & Sara Nason, W5717 Ridge Road, regarding recent paving of Ridge Road, requesting corrective action for damage to property—Road was resurfaced on June 2, 2009, 6-7 inch drop from roadway to his driveway, Pat did put gravel in driveway, but has washed away in the rains, would like an apron put on his driveway to solve problem, would also like us to cover the damage to his car ($609 estimate), it is not the obligation of the Town to provide access to the road, nor is the Town responsible for the damage to the vehicle, Motion to deny the claim to the vehicle, and it is the assumption that the road commissioner will continue to work on the driveway with gravel (Bromley/Sukala) Motion carries.
  14. Repair for Deakin Isle Bridge—had a bid for repairs, Attorney has concerns regarding the bid spec, also concern regarding prevailing wage law, Motion to proceed with the bridge repair based on bid previously received and ensure that the contractor comply with the prevailing wage (Bromley/Schramm) Motion carries.
  15. Possible tree removal at W5205 Sterlingworth Court—trees are still alive, could wait until next year for budgeting purposes, Motion to wait until 2010 and get bids for removal of the trees (Bromley/Sukala) Motion carries.
  16. Culvert replacement and riser installation at W5155 Sterlingworth Court—usually culvert falls on home owner, however, this culvert ties in with our water system, have received a bid from Flitcroft Septic services to do work—12” culvert-$600, catch basin-$250, Riser install and backhoe labor-$700, Township to provide minimal gravel and dispose of old culvert--$1550 total bid, could possibly get culvert directly from Western Culvert, Home owner at W5155 Sterlingworth willing to help with cost. Motion to undertake the culvert replacement at W5155 Sterlingworth court not to exceed $2,000 (Bromley/Sukala) Motion carries.
  17. Discussion/possible action regarding a bid from Inland Dredging for dredging at the boat house at W5633 West Shore Drive and neighboring properties—need to publish bid request, and have to comply with prevailing wages, total cost of project is approximately $21,000, need to get permits in order as permits will take some time to acquire, Motion to advertise for bids and proceed with procuring permits for project (Bromley/Sukala) Motion carries.
  18. Floyd Pochowski—discussion regarding clean boats, clean waters—hands out brochures to boaters for information, looks at boats, also asks questions to boaters, will share information with the board
  19. Update on investigation regarding the April 05 election—nothing new
  20.     --Motion to approve properly submitted bills for payment (Bromley/Sukala) Motion carries.
Motion to adjourn Bromley/Schramm at 9:49 p.m. Motion carried.
